As a family law attorney and as a practicing Catholic - and as someone who was once accused by my husband's ex-wife in a court declaration of having "Catholic paraphenalia strewn around my home" - I have something to say.
First of all, the judge has no legal basiss under the First Amendment to make this order. In California, a judge is generally going to say, "Well, Mom, when she is with you, you take her to temple, and when she is with Dad, you take hre to church."
And why? Listen, if religion is that important to you, marry in the faith. And realize that someone who converts to marry you is not likely wedded to the faith.
Frankly, I see both of these idiot parents as playing the religion card as a control mechanism in a divorce. And, as such, both are violating the 2nd Commandment.
Chances are good this kid emerges with no faith. Congratulations, Mom and Dad.

Don't get me started.....K?
OK
OMG!
I too am guilty of "Catholic paraphenalia strewn around my home"
What is the penalty (here on earth) for this crime?
Don't tell me that the penalty is a lifetime of indentured servitude to the ACLU! Oh gosh!

When did "you know who" start answering himself? Is this a new affliction or did I just not notice before?
DW, if you've forgotten "you know who", you may have early dementia.
My father once said to me, "Don't date anyone you wouldn't marry."
I thought he was being as ass but when I was about to get married, I realized the wisdom of his words. What he was saying was, stick with your own religion because if you give the kids mixed messages and "let them chose when they get older", they won't. They won't have any basis in faith.
So, I married, had a child, raised her in our same-religion family, got a divorce when she was married, eventually remarried a nice Jewish man, my daughter converted from Christian to Jewish and Orthadox at that.
Dad was an ass. I just should have stuck with that nice Jewish boy from the first. What a gip!
*snort*
Heaven probably is. My family left the church when I was 7 and I still turned out Catholic.
I agree that she should be able to take her to temple, and he should be able to take her to church.
Were I draw the line, however, is at baptism. He agreed to raise their children as Jews, yet he snuck off and has his daughter SECRETLY baptized. I suspect he did it to upset his wife and her family, and that is very wrong.
