The city council of Orange in Orange County, CA adopted a new law placing restrictions on registered sex offenders for Halloween.
The law requires that they do not answer the door on Halloween night, instead putting up a sign saying there is no candy and turning off their porch lights. In fact, they cannot put up any sort of Halloween decorations.
That last bit got me wondering whether something like that could withstand a constitutional challenge. Arguably, it is an issue involving the First Amendment and freedom of speech. I could see an argument that the particular restriction does not serve the purpose for which it is intended. After all, go look at the costumes at Party City - is not Halloween as much an adult holiday, maybe even more so, than one for children?
I wonder if the ACLU would back this one?
